By using Deplexed you agree to what follows. If you do not, please do not use it.

who you are agreeing with

Deplexed is operated from Cyprus by its owner. In these terms “we” and “us” mean the owner and operator of Deplexed, and “you” means you. Anything in here can be raised at hello@deplexed.com.

who may use it

You must be at least 13 years old to have an account, and old enough where you live to agree to terms like these on your own. If you are under 16 and your country requires a parent or guardian to consent on your behalf, they need to agree to this before you sign up.

what deplexed is, and is not

Deplexed is a training and entertainment app. Its exercises, scores, aptitude estimates and insight reports are for interest and self-tracking only.

They are not a medical device, a clinical assessment, a diagnosis, or a substitute for professional advice. No score here, including any IQ or aptitude figure, is a validated psychometric measurement, and none of it should be used to make decisions about your health, education or employment. If you are worried about your memory, attention or cognition, speak to a doctor.

Scores depend on your device, screen, input method, tiredness and practice. Improving at an exercise means you have improved at that exercise; broader claims are not made.

your account

You are responsible for what happens under your account and for keeping your password to yourself. Pick a username that is not offensive and does not impersonate someone. Usernames may be reclaimed if they do.

You can delete your account at any time from Settings. We may suspend an account that is being used to harass people, cheat leaderboards or break these terms.

fair play

Leaderboards only mean anything if the scores are real. Do not automate exercises, tamper with results, or submit scores you did not earn. Fabricated entries are removed and repeat offenders lose their accounts.

content you post

Club posts, suggestions and reports stay yours. By posting you allow us to display and store them within Deplexed. Do not post anything unlawful, abusive or that is not yours to share.

no warranty

Deplexed is provided as is and as available, without warranty of any kind. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We try hard to keep it working and to avoid losing your data, but we do not promise that it will be uninterrupted, error free, secure against every attack, or that any result it shows you is accurate.

Nothing here removes rights you have as a consumer that cannot be removed by agreement. Where your local law gives you guarantees that cannot be excluded, they still apply.

limits on what we owe you

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, nor for lost progress, lost data, lost profits or lost opportunity, nor for any decision you take on the basis of anything the app tells you.

Where liability cannot be excluded, our total liability to you for everything connected with Deplexed is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty euro. Deplexed is currently free, so for most people that is the fifty.

None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

if you cause us a problem

If someone brings a claim against us because of what you posted, how you used Deplexed, or because you broke these terms, you agree to cover the reasonable costs and damages that result. We will tell you promptly if that happens and will not settle anything in your name without asking you first.

if you installed this from the app store

These terms are between you and us, not between you and Apple. Apple is not responsible for Deplexed or its content, has no obligation to provide support or maintenance for it, and gives no warranty of any kind for it. Any claim that the app fails to conform to a warranty is ours to handle, not Apple’s, and Apple is not responsible for third-party claims about the app, including product liability and intellectual property claims. You confirm you are not in a country subject to a United States embargo and are not on a prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

ending it

You can stop using Deplexed and delete your account whenever you like. We may suspend or end access for anyone who breaks these terms, and may stop offering the service altogether. The sections on measurement, warranty, liability, indemnity and governing law survive after your account is gone.

governing law

These terms are governed by the law of the Republic of Cyprus, and the courts of Cyprus have jurisdiction over disputes about them.

If you are a consumer in the European Union, the United Kingdom, or anywhere else whose law gives you the right to bring proceedings in your own country and to rely on your own consumer protections, that right is not affected by this section. Nothing here is meant to take a mandatory protection away from you.

the usual general points

If any part of these terms is found unenforceable, the rest still applies. Not enforcing something once does not waive it. You may not transfer your rights under these terms; we may transfer ours if Deplexed changes hands, and your rights are unaffected if that happens. Together with the Privacy Policy, this is the whole agreement between us about Deplexed.

changes

These terms may change as the app does. The date at the top shows when they last did; continuing to use Deplexed after that means the new terms apply. If a change materially reduces your rights, the app will say so rather than relying on you to re-read this page.
